Concept plan for 260 house lots in Victoria Point’s emerging communities zone

Plans for 260 new houses at Brendan Way and Clay Gully Road in Victoria Point have been approved by the Planning and Environment Court in a consent decision ordered by Judge Rackemann on 1 April 2021.

This project is just the beginning for housing development in Victoria Point’s Emerging Communities zone.

Many other development applications are currently the subject of appeals against Council refusals.

This week, consultation began on another impact assessable application for development at 47-57 Clay Gully Road.

Delay in preparing a Victoria Point structure plan

Plans for 270 dwellings, submitted by Ausbuild six years ago, were rejected by Redland City Council at its general meeting on 21 March 2018, against the recommendation of Council officers.

The proposal was controversial and attracted more than 350 submissions during the consultation process.

At its meeting in 2018, the Council resolved in an 8/1 decision that “the application is deferred until a Council led Structure Plan is completed for the whole emerging community zone situated between Bunker Road, Double Jump Road, Brendan Way and Clay Gully Road”.

The Council voted, at its general meeting on 10 October 2018, to prepare a structure plan for the emerging community zoned land at Victoria Point.

Mayor Karen Williams said afterwards that the community would be engaged during the development of the structure plan, which would be delivered in nine stages with a target of September 2019 for final approval and incorporation into the Redland City Plan.

The making and approval of this structure plan was discussed at two Council meetings:

  • On 20 November 2019 the Council voted to submit its plan to the State Government for state interest review and approval to progress to public consultation.
  • On 10 June 2020 the Council discussed revisions to the plan and voted to seek Government approval to undertake public consultation.

Ausbuild sells the Clay Gully project to Urbex

Ausbuild announced in September 2018 that it was pulling out of the project. Urbex, a subsidiary of the BMD Group, acquired Ausbuild’s interests through a special purpose entity known as Clay Gully Pty Ltd.

Clay Gully Pty Ltd lodged an appeal against the Council’s 2018 rejection decision on 25 February 2020.

During the appeal process, the new owner was unable to retain contractual rights to a small parcel of land on the western edge of the proposed development site which has led to a small reduction (from 270 to 261) in the number of housing lots approved for development.

The current South East Queensland regional plan, adopted by the State Government in 2017, designates this part of Victoria Point as an ’emerging community’ zone.

Within the footprint of the Victoria Point Emerging Community Zone applications have been lodged for several other residential subdivisions which have been refused by Redland City Council and are currently the subject of appeals:

  • 275 lots proposed by Sutgold Pty Ltd (Fiteni Homes) for 36-56  Double  Jump  Road, 26 Prospect Crescent and 27  Brendan Way, Victoria Point RAL18/0127;
  • 176 lots proposed by Sutgold Pty Ltd (Fiteni Homes) for 72, 74, 78, 80, 82 Double Jump Road, 158-166, 168-172 and 174-178 Bunker Road, Victoria Point ROL006166;
  • 157 lots proposed by Sutgold Pty Ltd (Fiteni Homes) for 52, 56, 62, 64 and 66 Double Jump Road, Victoria Point RAL18/0128;
  • 37 lots proposed by Sutgold Pty Ltd (Fiteni Homes) for 26 Prospect Crescent and 27 Brendan Way, Victoria Point RAL18/0127;
  • 23 lots proposed by Paige Pty Ltd for 152-156 Bunker Road, Victoria Point ROL006210.

Development application for 47-57 Clay Gully Road

Impact assessable development application RAL/20/0079 has been advertised for public consultation.

The developer is proposing to subdivide one into eleven lots.

The deadline for making submissions is 7 May 2021.

How these developments are allowed to be pushed through with no regard for the people who already live here having to to put up with such poor infrastructures ,lack off schools,hospitals, fire
ambulance and police stations is truly beyond belief.
